Petition under section 13 of Hindu Marriage Act, 1955

Application under section 24 of the Hindu Marriage Act, for grant of ad-interim maintenance pendentelite allowances to the applicant-respondent.

 

RESPECTFULLY SHOWETH:-

  1. That the above noted petition under section 13 of Hindu Marriage Act, 1955 is fixed for hearing before this Hon’ble Court for today.
  2. That on account of the harassment and cruelties caused by the petitioner-husband and on account of being ousted from her matrimonial home the applicant-respondent is residing in her parental house ever since 05-11-2011. The minor son namely Puneet Sharma is also residing with the applicant-respondent. The minor son is studying in Kanti Memorial HR Sr. Sec. School, at Ghaziabad in UKG class. The applicant-respondent has no source of income whatsoever. Her entire expenses and as also the expenses for the upkeep and maintenance of her minor child like school fee, books, dress, diet etc is also being incurred by the father of the applicant-respondent.
  3. That the petitioner-husband is a diploma holder in Engineering of 1st Class regarding merchant Navy and he is working as Sr. Engineer with the Merchant Navy in U.K. (foreign country) and he is getting a handsome salary of Rs. 24,00,000/- (Rupees Twenty Four Lacs only) per package and the terms of the package of 6 months i.e. monthly income of the petitioner-husband is Rs. 4,00,000/- per months (Rupees Four Lacs only).
  4. That in these circumstances the petitioner-husband should be directed to pay a sum of Rs. 21,000/- towards litigation expenses to the applicant-respondent and further a sum of Rs. 1,00,000/- per month as interim maintenance pendent-lite.
  5.  It is, therefore, prayed that the petitioner-husband should be directed to pay Rs. 21,000/- as litigation expenses and Rs. 1,00,000/- per month as interim maintenance allowance to the applicant-respondent.

                     It is further prayed that the petitioner-husband may also be directed to pay Rs. 1,000/- per hearing to the respondent-applicant towards travelling allowance.
