The Deed of Divorce was executed between Smt. A and Shri B who got married six months ago according to Muslim rites and ceremonies. Due to family and temperamental differences and false cases and litigations launched by the parents of the first party, both parties agreed to dissolve their marriage by way of this Talaqnama/Divorce Deed according to Muslim Shariat Law. B has given Talaq to A by saying it thrice. The contents of the deed were read and accepted in the presence of family members, arbitrators/elders, and witnesses. However it is wroth to note that the five-judge bench of the Supreme Court declared the practice of Triple Talaq unconstitutional by a 3:2 majority and directed the legislature to take measures against it in order to stop the abuse against women.
This deed of Divorce has been executed at ______on this 9th day of March, 2016 between :
1- Smt. A (hereinafter called the FIRST PARTY )
2- Sh. B (hereinafter called the SECOND PARTY)
WHEREAS, the marriage of both the parties was solemnized about 6 months ago at ______ according to Muslim rites and ceremonies and the same was a love marriage by the sweet will of both the parties.
AND WHEREAS, despite best efforts by both the parties and their near and dear ones and family members and elders of the society it has become impossible for both the parties to live as husband and wife due to their family and temperamental differences and as well as due to the false cases and litigations launched by the parents of the first party against the second party and as such there is no hope for any future reconciliation hence both the parties with the active support of their parents and elders of both the sides hereby agreed to dissolve their marriage /NIKAH by way of this TALAQNAMA /Divorce deed in the presence of witnesses and according to Muslim Shariat Law.
THAT in pursuance thereof the second party hereby TALAQ, TALAQ, TALAQ the first party and from now on renders her HARAM for himself.
WHEREAS, the contents of this TALAQNAMA/Divorce Deed have been read over to us in simple Hindi and have very well understood by us and have been accepted thereof in the presence of family members, arbitrators/elders and witnesses.
